Departures (DDS/DPLS/DSDS)

A Departure grants relief from the strict application of requirements for: (1) the design of parking and loading facilities (DDS); (2) the number of parking and loading spaces (DPLS); (3) sign regulations (DSDS); and (4) landscaping, buffering, and screening requirements of the Landscape Manual (DDS).

Pre-Application Conference:  Optional under current Zoning Ordinance. Required under new Zoning Ordinance for Major Departures and optional for Minor Departures. 

Pre-Application Neighborhood Meeting: Optional under current Zoning Ordinance. Required under new Zoning Ordinance for Major Departures and optional for Minor Departures.


Subdivision and Development Review Committee (SDRC): Departure applications may be referred to the SDRC, at the discretion of the section Supervisor or at the request of the applicant.

Decision-Making Body: Departures are generally ruled upon by the Planning Board. However, the Planning Director may rule upon Departures from Parking and Loading Standards (DPLS) and Departures from Sign Design Standards (DSDS) when the Departure is a maximum 10% of standard requirements. Municipalities may also have the authority to rule upon Departures if delegated by the District Council to a Municipal Corporation or through the establishment of a Revitalization Overlay District.

Public Notice Requirement

For Departures from Parking and Loading Spaces (DPLS) - Public hearings shall be advertised by posting of a sign(s) for at least 15 days. Notice shall also be sent to all persons of record and municipalities. For Departures ruled upon by the Planning Director, the property shall be posted within 10 days of the Director's acceptance of the filing of the application.

For Departures from Sign Design, Parking Design, and Landscape Manual (DSDS/DDS) - Public hearing shall be advertised by posting of a sign(s). No time frame is specified. The Planning Board requires the sign(s) to be posted for at least 30 days. Notice shall also be sent to all persons of record and municipalities. For Departures from Design Standards (DDS) ruled upon by the Planning Director, the property shall be posted within 10 days of the Director's acceptance of the filing of the application.
